It is no secret that the current border situation has brought gigantic challenges to the Biden administration, which is trying to promote the first comprehensive immigration overhaul in decades. With this, we refer to a surge of illegal border crossings that has increased exponentially since early 2021, which represents the highest border apprehension rate in 20 years.

Despite the fact that President Joe Biden has had to face a gigantic social controversy related to the border situation, especially when it comes to unaccompanied immigrant minors and the processing of these cases within the US, his administration has been able to move forward with several immigration plans so far in May, greatly benefiting local businesses that need to hire foreign workers and the most vulnerable immigrant communities such as asylum seekers.

Let’s look at the Biden administration’s most important actions on the immigration system in May 2021:

1. Refugee limit

President Biden increased the refugee limit for the remainder of fiscal year 2021 (October-September), from 15,000 (Trump’s cap) to 62,500, which is a great achievement for immigrant populations and their place in the US’ social fabric.

2. No more restrictions for L-2 and H-4 visa holders

Biden’s USCIS (US Citizenship and Immigration Services) suspended certain biometric requirements to renew H-4 and L-2 visas, two visa programs for spouses of H-1B and L-1 (A-B) visa holders respectively, which are available for highly skilled foreign workers and intra-company transfers.

3. Biden protects foreign entrepreneurs

The Biden administration decided to protect a program available to foreign entrepreneurs called IER (International Entrepreneur Rule) and stated that it will promote this benefit to attract talent from abroad in times of crisis.

4. Biden reverses order related to immigrants and the health system

The Biden administration recently reversed a Trump order to reject certain immigration cases if the applicant could potentially become a burden on the healthcare system.

5. TPS for Haiti

Biden’s DHS (Department of Homeland Security) recently extended TPS (Temporary Protected Status) for eligible Haitian nationals for 18 months. It is important to clarify that TPS is a deportation relief program, which offers multiple services to beneficiaries such as the possibility of requesting an EAD (Employment Authorization Document).

6. Biden will help immigrants in their naturalization process

The Biden administration recently announced that it plans to assist LPRs (Lawful Permanent Residents) in their naturalization process to become American citizens.

7. The US receives vulnerable immigrants

The Biden administration will allow “particularly vulnerable” immigrants to enter the US as an exception to current border restrictions related to the global Coronavirus pandemic. Under this exception, certain immigrants who have been waiting in Mexico in risky circumstances will be able to process their cases at the borders.
