Immigration has always been a controversial topic in the US. However, social disagreement around the immigration sector has increased considerably since President Trump took office in 2017.

His immigration policies have been classified as “arbitrary, capricious and invasive” by activist organizations and immigrant rights advocates.

The Trump administration argues that mass immigration lowers the quality of life for American citizens, affects the local economy and depletes essential resources. The Trump government’s view is even more controversial compared to the previous administration, led by President Barack Obama, who had more welcoming immigration policies and implemented multiple benefits for immigrants currently residing in the US.

Conversely, President Donald Trump’s administration aims to eradicate these immigration benefits, reduce the number of visas issued by the US Citizenship and Immigration Services (USCIS), and increase requirements for foreigners to be able to come to the country.

Therefore, as current immigration policies unleash a gigantic social controversy, the Trump administration faces multiple legal processes simultaneously, which have already reached the US’ Supreme Court of Justice.

Supreme Court intervenes in three immigration policies

Currently, there are three immigration proposals from the Trump administration that have reached the Supreme Court of Justice due to legal complaints that have not been resolved.

1. The Trump administration wants to remove undocumented immigrants from census

Every 10 years, the US population must participate in the national census, which is used to calculate population density, distribute seats in Congress, analyze the behavior of the economy, and disburse national funds to each state for local investment.

2020 is one of the census years. At the end of July, the Trump administration proposed to exclude undocumented immigrants from the census, so that they do not intervene in the congressional count.

The Trump government states that foreigners who violate local law should not be considered in any legal process such as the census. However, multiple states refuted this premise, stating that their population density increases due to illegal immigration and that excluding them from the census would reduce seats in Congress and the national fund distribution.

In mid-September, the Trump administration announced that it was going to take the census case to the Supreme Court of Justice.

2. The MPP policy

The Trump administration implemented the Migrant Protection Protocol (MPP), or “Remain in Mexico”, in January 2019. Under this policy, asylum seekers must remain in Mexico while receiving a response to their immigration applications.

Naturally, due to current conditions in Mexico and the needs of asylum seekers, this policy has received countless criticism and the controversy reached the Supreme Court of Justice.

3. Trump’s border wall

The Trump government promised to build a border wall between Mexico and the US during his term. Trump’s border wall is intended to curb illegal immigration from Central America.

However, the Supreme Court of justice intervened in the case because the Trump administration has multiple accusations of diverting national funds for the construction of the border wall.
