Trump Government Involves the Supreme Court to Exclude Immigrants From Census

Trump government continues with the intention of removing undocumented immigrants from Census

What is the national census?

To give a brief explanation, the National Census is a mandatory survey that is carried out every 10 years in order to calculate the population density of each state and its relationship with the behavior of the local economy.

Adding to that, after obtaining the results of the Census, the US government has the duty to allocate federal funds to each state and distribute seats in Congress depending on the population density.

The Trump administration’s intention to remove immigrants from the Census

In late July, 2020, the Trump administration signed a memorandum proposing to remove undocumented immigrants from congressional count, which depends on the results of the National Census.

The current administration of the US ensures that individuals who decided to cross the country’s borders without prior authorization should not be taken into account in the census, mainly because they violated local law and should not receive benefits from the government.

In addition to that, President Trump assures that it would be inequitable to distribute seats in Congress counting undocumented immigrants since they increase the population density in several states.

Court blocked proposal from the Trump administration

In early September, a New York court blocked the Trump administration’s proposal to remove undocumented immigrants from the census.

The judges involved in the case declare that everyone should be included in the National Census, regardless of their immigration status. They state that the main purpose of the census is precisely to count the number of people currently residing in the US, and excluding immigrant communities would affect multiple states.

On top of that, if the Trump administration’s proposal is accepted, it could increase social division and discrimination, which is growing exponentially due to different political ideals and the fact that presidential elections are approaching.

Trump intends to involve the Supreme Court in order to exclude undocumented immigrants

On Wednesday, September 16, the Trump administration, through the Department of Justice (DOJ) stated that it plans to take the census case to the US Supreme Court for further review.

In addition to that, last year, the current administration of the US also asked the Supreme Court to include a citizenship question in the census, a request that was rejected.

Now, the Trump administration plans to get an answer before the end of the year, so that it can distribute seats in Congress depending on the verdict of the Supreme Court of Justice.

Given the trajectory of this controversy, it is highly possible that activist groups and government officials from multiple states will file legal complaints due to this move by the Trump administration on the US immigration sector.
