Refugee Process Under the Current Administration

Immigrants fleeing danger and persecution

For decades, the US has been the destination of thousands of immigrants who ask for international protection through refuge in order to save their lives from threat, danger, persecution, abuse, violence or war.

Immigrants can request refuge when they are outside the US and must demonstrate with evidence that they are or have been victims of situations that threaten their integrity because of their race, religion, political opinion, sexual orientation, nationality, inter alia.

Foreigners interested in seeking refuge must meet certain mandatory requirements in order to obtain this benefit and be eligible to legally reside in the US.

Initially, immigrants must have an interview with a specialized officer of the US Citizenship and Immigration Services (USCIS), who decides if they meet requirements and qualify under the refugee term.

The current government’s opinion regarding refugees

The current administration of the US, led by President Donald Trump, has always proposed to reform the immigration system and implement immigration options based on merit, rather than family ties or humanitarian programs.

Annually, the country’s government must determine the number of refugees allowed during the following fiscal year (October-September). The US has received the largest number of refugees in the world for decades. For instance, the previous administration, led by president Barack Obama, allowed 100,000 refugees annually.

However, the Trump administration reduced this figure by more than 80% during fiscal year 2020, allowing the entry of just 18,000 refugees. Adding to that, for fiscal year 2021, the current administration reduced that figure by 16% and will allow the entry of 15,000 refugees in the US during the current fiscal year. This figure makes Canada the country that receives the most refugees in the world now.

Apart from that, to fulfill the purpose of curbing immigration, the Trump administration has proposed to create agreements with third countries, mainly from Central America, so that immigrants first request refuge there before reaching the US.

In fact, in one of our most recent articles, we talk about comments from current administration officials, who state that if President Trump wins a second term in the upcoming elections, he would increase restrictions on humanitarian programs such as political asylum or refuge and expand agreements with more countries to reduce the number of refugees in the US.

Modifications in the refugee process have drawn the attention of hundreds of activists, immigrant rights advocates and critics, who assure that the Trump government is violating human rights and evading the responsibility of welcoming to the most vulnerable communities.
