Judge Rules in Favor of the Diversity Visa Lottery

Judge order the Trump government to issue Green Cards from the Diversity Visa Lottery

The arrival of the pandemic and the Diversity Visa Lottery

The immigration system of the US is quite extensive. With this, we refer to the fact that foreigners have a wide variety of options available to apply for a legal entry and residence permit.

In addition to that, immigrants have the possibility to submit an application for Legal Permanent Residence (LPR), also known as Green Card.

There is a program related to Green Cards named the Diversity Visa Lottery. This program randomly grants 50,000 green cards per year to foreigners of different nationalities, so that they can come to the US and reside legally.

Naturally, the sudden arrival of the global Coronavirus pandemic and its massive outbreak in the North American territory forced the Trump administration to implement emergency measures that directly affect the immigration sector of the US.

For instance, the Diversity Visa Lottery has not been available since April 2020 and, according to President Trump, its restoration depends on the country’s progress with the massive outbreak of COVID-19.

The Trump administration already faces a lawsuit over the Diversity Lottery

Hundreds of immigrants raised their voices and expressed their disagreement with the suspension of this program, especially those who had already won the lottery, but have not been able to come to the US due to restrictions from the Trump administration.

In fact, in one of our most recent articles, we talk about a group of approximately 500 foreigners who filed a lawsuit against the Trump administration because they already won the visa lottery and got their Green Cards, but due to the suspension of the program, they have not been able to start their immigration journey in the US.

Plaintiffs argue that the country could benefit greatly from their talents and their desire to progress and offer their best qualities to local socio-economic development.

Judge rules in favor of the Diversity Lottery

On Friday, September 4, 2020, a federal judge ruled in favor of the Diversity Visa Lottery and ordered the Trump administration to issue the Green Cards that had already been approved during the first quarter of the year.

The judge also stated that the current administration should not judge or associate lottery winners with crime or any other negative term. In fact, he states: “Diversity visa lottery winners are people who have come to this nation, like millions before, to seek a better life for themselves and their families, and to pursue the American Dream.”
