The Trump administration has always been fairly strict when it comes to immigration, both legal and illegal. In fact, one of its main goals is to reduce the number of immigrants that enter the US annually and to deport those who managed to cross the borders without legal documentation.

In addition to that, the sudden arrival of the global COVID-19 pandemic contributed to the Trump administration increasing restrictions and requirements in legal immigration processes.

For instance, in June 2020, the Trump administration released a presidential proclamation called “Proclamation Suspending Entry of Aliens Who Present a Risk to the U.S. Labor Market Following the Coronavirus Outbreak.”

Broadly speaking, the White House leader stated that most work visas, including H-1B visas for highly skilled foreign workers, will not be available until 2021. With this, the Trump administration aims to protect employment of American citizens during the sanitary emergency and reduce the current unemployment rate.

However, multiple sectors of the local market benefit greatly from foreign workforce and dozens of renowned companies and entities raised their voices, asking the government to revoke this decision as it could generate a devastating workforce shortage.

Legal process against restrictions on business immigration

In July 2020, multiple entities such as the US Chamber of Commerce and the National Association of Manufacturers filed a lawsuit against the Trump administration for restricting business immigration during the current juncture.

They argue that this is the time when the US needs the talent and innovation of highly qualified foreign workers, who are a key piece to overcome the economic crisis brought by the Coronavirus pandemic.

Adding to that, in early August, dozens of renowned companies decided to support the lawsuit, arguing that they could not meet market demands without foreign workforce.

We are referring to titans of the technology industry such as Amazon, Apple and Microsoft, who also stated that they would possibly have to move their businesses to other countries that do appreciate the talent of qualified foreigners.

Judge blocks the Trump administration’s restrictions on employment visas

On Thursday, October 1, a federal judge of the Northern District of California temporarily lifted the Trump administration’s restrictions on employment-based visas for companies and entities involved in the legal complaint.

Therefore, the Trump administration’s restrictions will not affect these entities until the lawsuit is resolved. Entities involved in the lawsuit responded to the judge’s verdict and one of them stated: “We are grateful the court recognized the real and immediate harm these restrictions have meant for manufacturers right now and stopped this misguided policy until the court can fully consider the matter.”

Important Fact

It is important to emphasize that the judge lifted restrictions on work visas only for the companies and entities involved in the lawsuit.

However, there are currently other similar legal processes and the federal judge verdict opens a door of hope for local businesses and employers.
