Experts: Democratic leaders could move forward with immigration plans

Reforming the immigration system is a goal for the current administration of the US, led by President Joe Biden. With this, Biden and his team hope not only to improve, optimize and streamline legal immigration processes, but also to provide legalization routes for millions of foreign nationals residing in the country undocumented.

However, the surge of illegal border crossings and obstructionism by opposition groups and certain Republican leaders have become a huge obstacle to the Biden administration and its plan to restructure the local immigration system.

Thus, in order to circumvent the Republican filibuster in Congress and subtly introduce comprehensive reform, Democratic leaders included an immigration resolution in the 2022 budget package, which would pass through the reconciliation process (with only 51 votes in the Senate) and proposes to open a path to citizenship for undocumented foreign workers.

However, the Senate Parliamentarian recently rejected the immigration language included in the spending bill, stating that it is not entirely a budgetary issue, but rather a prominent change in immigration policies.

Democratic leaders slightly transformed the immigration proposal in the budget package, but the Senate Parliamentarian rejected it again. Now, it appears as if the Biden administration is accepting the Senate Parliamentarian’s opinion as an order, which is not the case.

What do Democrats need to accomplish immigration reform?

According to several experts, if Democratic leaders accept the opinion of the Senate Parliamentarian it is because they want to and the situation would simply become “political theater”.

This is because, if Democratic leaders continue to pursue immigration reform through the reconciliation process, they would only need to organize their congressional caucus in order to circumvent the Senate Parliamentarian’s opinion.

In fact, the director of Liberty Government Affairs explains, “if Democrats want to use reconciliation to do an end-run around the filibuster. They can, even if the parliamentarian recommends against it, if they can hold their caucus together”.
