Would Biden’s Plan Protect Local Workforce?

How would Biden's spending bill help local companies?

Biden’s budget package might fill labor gaps

Biden’s spending bill, called the BBB (Build Back Better) agenda, which is currently under Senate scrutiny, proposes to invest a considerable amount to improve the local immigration system and expand the foreign worker network to boost the economy in times of crisis.

In fact, the reason why Democratic leaders included several immigration provisions in the budget package is because, in their view, foreign workforce is a pillar of the country’s economic stability and needs to be protected to ultimately protect the American population.

Therefore, through the spending bill, Biden seeks to provide a path to legalization, even if temporary, for eligible undocumented workers, while at the same time to streamline existing business immigration processes so that foreigners can have access to a simple and efficient immigration system.

Let’s take a look at some of Biden’s most important proposals:

Recapture Green Cards

Biden’s BBB agenda proposes to recapture and issue Green Cards not used since 1992. It is worth explaining that:

  • Green Cards grant lawful permanent residency.
  • Each FY (Fiscal Year – October/September), the USCIS (US Citizenship and Immigration Services) issues only a certain number of Green Cards, which also have a per country cap. However, when the USCIS does not reach the annual limit, unused Green Cards cannot be recaptured the following year.

Thus, if the Senate passes Biden’s budget package, an estimated 157,000 employment-based Green Cards would be available again, offering permanent protection to documented foreign workers.

Temporary deportation relief and employment authorizations

After changing immigration provisions several times, Biden’s BBB agenda now proposes to expand the parole power to offer temporary protection from deportation (for up to 10 years) to approximately 7 million undocumented immigrants.

If passed, this provision would:

  • Allow undocumented immigrants to apply for employment authorization while covered by the parole power.
  • Offer employment authorization to foreign farmworkers and Dreamers, young immigrants who came to the US without legal documentation as children.

How would Biden’s spending bill help local companies?

According to a recent report, the immigration provisions included in Biden’s budget package would protect the local economy, boost international competitiveness in times of crisis, and fill labor gaps.

Let’s look at why:

  • According to official USCIS figures, as of June 2021, there were more than 1.3 million pending employment authorization applications, both initial applications and extension applications.
Thus, the Democratic leaders’ plan would expedite employment application processing and reduce the backlog of immigration cases across the country.
  • Approximately 1.5 million immigrants are on the employment-based Green Card waiting list and, since there are only 140,000 available each year, waiting times are abysmally long.
Therefore, the Democratic leaders’ plan would reuse Green Cards from the past three decades and reduce waiting times for eligible applicants.
