Biden’s budget package might reuse Green Cards

Biden’s spending bill includes an immigration provision that proposes to issue Green Cards unused since 1992, which would allow eligible foreign nationals to access lawful permanent residency faster.

It is important to explain that the US issues a certain number of Green Cards annually (Fiscal Year – October/September), which also have a per country cap.

If for some reason the annual limit is not reached, then unused Green Cards cannot be issued the following fiscal year. In other words, they are not reusable.

To give a little more context, the provision included in the budget package:

  • Would allow the issuance of more than 400,000 unused Green Cards from the last three decades.
  • Would allow eligible employment-based visa holders to pay a $5,000 fee to evade the annual cap and also the per-country cap.
