Trump’s Administration Faces New Lawsuit Because of Work Visas

174 Indian Nationals file a lawsuit against work visa restrictions

Another political controversy for the Trump administration

The arrival of the Coronavirus forced governments around the world to execute emergency measures to mitigate and counter the impact of the global pandemic.

Many countries have chosen to implement similar measures such as closing borders, using mandatory quarantine for social distancing, banning non-essential travel (which does not involve trade exchange), inter alia.

In the case of the US, the pandemic brought, besides the health crisis, a political, social and economic crisis.

Recently, during the last two months, the current administration of the US, led by President Donald Trump, has announced multiple action plans to protect the health of the local population, as well as safeguard resources, protect American workers, the market and the country’s economy.

The current problem is that most of these measures are directed at the immigration sector of the US. This creates a gigantic controversy due to the fact that the Trump administration has constantly reiterated (since 2017) its intention to reduce immigration.

Thus, multiple critics, expert attorneys, immigrant communities, activists, immigrant rights advocates and non-profit organizations have labeled these measures as “convenient” with the immigration agenda of the current administration.

Trump’s administration faces multiple lawsuits

The current administration of the US just emerged from a controversy due to restrictions implemented on student visas.

Multiple universities around the country filed several lawsuits against the limitations for international students.

However, during the hearing that took place in a Boston court on July 14, 2020, government officials retracted and removed these restrictions.

Other than that, the Trump administration is facing several simultaneous lawsuits. For instance, almost 500 immigrants filed a legal complaint against the restrictions applied on the Diversity Visa Lottery.

Now, several representatives of Trump’s cabinet will face a lawsuit filed by 174 people from India who are restricted from applying for work visas in the US.

The new lawsuit due to work visa restrictions

This lawsuit is specifically directed at:

  • Secretary of State, Mike Pompeo.
  • Secretary of the Department of Homeland Security (DHS), Chad Wolf.
  • Labor Secretary, Eugene Scalia.

The official statement declares that the 174 Indian nationals claim their right to obtain the H-1B visa for qualified foreign workers, as they meet all the requirements and have already passed through the filters.

The lawsuit primarily calls for the removal of restrictions on work visas and for the Department of State (DOS) to finish processing pending applications for the remainder of the year.

Why did Trump decide to suspend work visas?

The Trump government ensures that temporarily suspending (until 2021) the issuance of work visas lowers the current unemployment rate and protects the wages of local workers.

In addition to that, the president assures that foreigners often use resources that are essential to overcome the current crisis, therefore, denying them entry is protecting the American population.

However, it is important to understand that in order for a company to obtain legal permission to receive foreign workers, it must first demonstrate that there are no local personnel to fill the job.

Therefore, the foreign workforce could be a key piece to overcome the economic crisis caused by the Coronavirus pandemic. Mainly, because foreigners bring innovative ideas and entrepreneurship projects that boost the economy and generate more jobs for the population.
