Trump administration reverses restrictions on student visas

Over the past week, one of the most discussed topics in the US has been the restrictions implemented by the Trump government on student visas.

On Monday, July 6, 2020, the Immigration and Customs Enforcement agency (ICE) released an official statement with new regulations that foreign students were to follow during the fall semester.

Broadly speaking, ICE stated that:

  • All foreign students currently residing in the US had to have at least a portion of face-to-face classes during the fall in order to stay in the country, otherwise they had to leave or could be deported.
  • Institutions that wanted to implement only virtual methodology during the fall, could not receive foreign students.

Due to these restrictions, dozens of schools and universities raised their voices and challenged the current administration of the US by filing multiple lawsuits and posting their opposition on social media.

The Trump administration decided to reverse these restrictions

One of the lawsuits filed against the Trump government was led by Harvard University and the Massachusetts Institute of Technology (MIT).

On Tuesday, July 14, 2020, representatives of both the Trump administration and the universities involved in the case had the first hearing session in Boston.

As soon as the hearing began, representatives of the Trump government stated that restrictions on student visas were lifted immediately.

Thus, the country’s most recognized universities and foreign students won the battle against restrictions on student visas. It means that international students can stay in the US even if they have only virtual classes during the fall semester.

The reason why the Trump administration rescinded the restrictions

Representatives of President Trump’s cabinet did not state their reasons for reversing the restrictions implemented on student visas.

However, if the Trump government had not decided to reverse this decision, it would have to face several judicial processes:

  • The Harvard and Mit lawsuit.
  • Lawsuit filed by 17 states.
  • Briefs in support of the lawsuits of more than 80 educational institutions around the country.
