Controversy surrounding Trump’s immigration policies

The Trump administration’s approach to the immigration sector unleashed a gigantic wave of controversy among critics, experts, activists and immigrant rights advocates, mainly because many of its policies affected vulnerable populations.

In a relentless attempt to reduce immigration, the Trump administration implemented multiple policies that, among other things:

  • Led to the separation of immigrant families at the borders. In fact, there are still 611 immigrant minors who have not been able to find their parents after more than three years.
  • Forced asylum seekers, who are fleeing persecution and violence, to remain in Mexico under the MPP (Migrant Protection Protocols) policy. They currently live in temporary shelters and often do not have access to basic services to survive. Some of them have been waiting there for more than a year.
  • Led to the construction of a border wall that separates the US from Mexico, which affected local ecosystems.
  • Considerably reduced viable alternatives for highly skilled foreign workers to come to the US, who are essential for the country to overcome the current crisis as they constantly boost the local economy.

Therefore, due to repercussions of his immigration policies, former President Trump and his team had to face multiple legal processes, and some of them even reached the US Supreme Court of Justice.

Supreme Court intervened on several Trump immigration policies

In October 2020, the Supreme Court of Justice intervened in multiple legal processes regarding immigration policies implemented by the Donald Trump administration and was going to deliver its verdict during the first months of 2021.

The Supreme Court was going to review:

  • The Trump administration’s request to remove undocumented immigrants from the National Census.
  • The construction of the border wall on grounds of National Emergency.
  • The validity of the MPP or “Remain in Mexico” policy and its repercussions.

Supreme Court cancels pending arguments about immigration policies

On Wednesday, February 3, 2021, the Supreme Court suspended hearings scheduled for next week regarding the use of national funds to build the border wall and the MPP policy, which forces thousands of asylum seekers to remain in dangerous places in Mexico.

The Supreme Court granted a petition by the DOJ (Department of Justice) after President Biden took office on January 20, 2021, who has already revoked and paused several immigration processes established by the Trump administration.

Thus, Biden’s DOJ asked the Supreme Court to remove two appeals made by the Trump government that are not necessary in light of the current administration’s immigration ideals and goals.
