Dozens of States File a Lawsuit Against Trump’s Order

35 states file a lawsuit due to Trump's order on census

Trump’s latest memorandum

The national census is a tradition established in the US since 1790. This census is carried out every 10 years and has multiple purposes.

The United States Census Bureau is the entity in charge of promoting social participation in the census, evaluating the results and sending them to the government so that it can make the pertinent decisions for each state.

Some of the purposes of the national census are:

  1. The census helps to count the number of people residing in the US and to observe the variation in population density every decade.
  2. With the results of the census, the government can distribute the seats of Congress for each one of the states.
  3. The census helps to analyze the behavior of the economy in relation to the population density of a specific region.
For example, how many jobs there are, the unemployment rate, entrepreneurship projects, among others.

The 2020 census has been embroiled in gigantic controversy due to a memorandum that President Trump signed on July 21.

The President’s Order

Broadly speaking, President Trump declares that undocumented immigrants should be excluded from the census and should not participate in the distribution of seats in Congress.

The president states that if immigrants decide to cross the borders of the US without documentation or legal authorization, then they should not count for government decisions.

This presidential order sparked a controversy among several states in the country and the Donald Trump administration.

35 states sue the Trump government

A total of 35 states filed a lawsuit against Trump’s order to exclude undocumented immigrants from the congressional distribution.

In the lawsuit, cities and counties claim that there are several states that have a higher population density due to the number of undocumented immigrants residing there.

Therefore, having fewer seats in Congress does not benefit the country, the Congress, the states, nor the immigrant communities.

In addition to that, one of the purposes of the census is to count the number of people residing in the US so that the government can distribute funds to each state.

To exclude undocumented immigrants would affect the quality of life of thousands of American citizens who would have to face the consequences of this presidential decision.

The Trump government’s response

The President of the US and his cabinet of senior officials did not comment on this lawsuit yet.

However, it is important for the Trump government to fully analyze the possible repercussions of excluding undocumented immigrants from Congress seat distribution.

In fact, some experts, critics around the country and even the Maryland Attorney General have stated in recent days that this presidential order serves two purposes.

  1. On the one hand, help the Trump government have more Republican participants in Congress than Democrats.
  2. On the other hand, continue to exclude immigrant communities that currently reside in the US without legal documentation, but that have an active immigration process.

If the government does not give a response to the plaintiff states, it is only a matter of time until the case reaches the court and a local judge has to intervene.
