In the first year of Joe Biden’s presidential term, Democratic leaders have not been able to accomplish much when it comes to immigration.

Several policy experts believe that expectations at the start of the administration were too high considering the extensive precedent of hard-line immigration policies left by former President Trump’s administration.

The balance of Biden’s Presidential term

The Biden administration’s goals with respect to immigration have become increasingly distorted during his term as he has focused on rescinding policies of his predecessor without much success. Among the most criticized by immigration advocates are:

  • The attempt to terminate the MPP (Migrant Protection Protocols) and the Fifth Circuit Court of Appeals decision that forced the Biden administration to continue its implementation from December 2021.
    This regulation limits entry to asylum seekers, so they must wait in Mexico until a court appointment is assigned.
    This policy has generated great controversy because asylum seekers may go through dangerous and risky situations while waiting in Mexico.
  • The continuation of Title 42. This regulation, which was established amid the COVID-19 health emergency, allows for the removal of immigrants apprehended at the southern border, without the possibility of applying for international protection to remain in the country.
    Critics of this regulation point out that there is no justification for its continued implementation since there are other viable alternatives to prevent the spread of the Coronavirus.

The promise of citizenship for undocumented immigrants

Another of the most anticipated campaign proposals by immigrant rights advocates is to include certain immigration provisions in Biden’s budget package.

However, the Senate Parliamentarian deemed the proposal unworkable and has rejected the immigration language in the spending bill on three occasions.

This agenda called Build Back Better sought to open a path to citizenship for at least 7 million immigrants who do not yet have legal documentation, but meet certain eligibility criteria in order to temporarily remain in the country.

However, after learning of the Senate Parliamentarian’s verdict, there is little chance that the spending bill will ultimately pass the Senate Democratic caucus.

The viewpoint of Democratic representatives

Department of Homeland Security Secretary Alejandro Mayorkas recently stated, “In this first year we have been rebuilding an immigration system that was dismantled by the prior administration (…) We have had to rescind cruel policies, bring offices back to life, issue new policies and rebuild entire operations”.
