Court of Appeals reaffirms the MPP reimplementation

The US Fifth Circuit Court of Appeals stopped a new attempt by President Biden’s administration to overturn the MPP rule, which was implemented during former President Trump’s administration.

Asylum seekers cannot enter the US under the MPP

The MPP policy, also known as “Remain in Mexico”, states that asylum seekers must remain in Mexican territory until they receive a response to their immigration cases, which usually takes a considerable period of time.

The current administration tried to rescind this policy mid-year, but a federal judge in Texas ordered Biden to reimplement it again in mid-August, stating that the DHS (Department of Homeland Security) did not follow due process.

After following the judge’s order, Biden’s DHS issued a new memorandum to rescind the MPP policy again, this time following the Texas judge’s recommendations. However, the Fifth Circuit Court of Appeals intercepted this attempt.

Although the Biden administration attempted to embrace some of the previous recommendations, the Court of Appeals finds that the proposal has “no input from Congress, no ordinary rulemaking procedures, and no judicial review, and therefore does not support the option of terminating the MPP at this time.
