The Trump Administration Could Stop Deporting Minors Amid Pandemic

Trump's government proposes removing measure that allows deportation of unaccompanied minors

Express deportations of unaccompanied immigrant minors

The massive outbreak of Coronavirus was sudden and took governments around the world by surprise. They had to quickly create action plans to mitigate the impact of the pandemic, protect the health of the local population, safeguard essential resources, and implement strategies to support the economy.

In the case of the US, the Trump administration implemented several emergency measures that are directly related to the immigration sector. For instance, immigrants were not allowed to enter the country for more than two months.

To achieve this goal, the Trump administration used two main strategies:

  1. On the one hand, legal immigration processes were suspended for a considerable period of time.
  2. On the other hand, border forces are using express deportations during the health crisis with immigrants who are detained trying to cross borders without legal documentation.

Normally, they are taken to immigration detention centers around the country until their deportation proceedings are complete or until they appeal their cases. However, the health crisis allowed the Trump administration to deport immigrants in less than 90 minutes, including minors.

There are hundreds of unaccompanied immigrant minors who arrive in the US with the intention of requesting political asylum or refuge. According to local law, they must remain in the custody of the Office of Refugee Resettlement (ORR) until their immigration cases are resolved.

The current problem is that they are also being deported amid the global Coronavirus pandemic. Naturally, this situation unleashed a gigantic controversy in the country.

The Trump administration considers removing this measure

The Trump administration recently released an official statement declaring that it will most likely revoke the emergency measure that allows unaccompanied immigrant minors to be deported from the US in a matter of hours.

This statement still needs approval, but if it becomes an official order, immigrant minors will be under the ORR supervision as usual.

It is important to clarify that the reason why the US law protects minors is because they are typically the main victims of abuse, domestic violence, human trafficking, kidnapping, inter alia. Adding to that, if immigrant children arrive in the country alone, it is precisely because they need international protection while they try to flee from precarious situations that put their integrity and life at risk.
