Texas Attorney General files legal complaint against the Biden administration

The Biden administration freezes deportations for 100 days

President Biden, who took office on January 20, 2021, has a fairly extensive immigration agenda. In fact, one of his main proposals was to remove Trump’s restrictive policies on the immigration system and present an immigration bill for Congress approval.

A comprehensive immigration reform would also mean changing the way the federal government approaches deportation and the immigrant detention system. To achieve this goal, the Biden administration initially proposed freezing deportations for 100 days, with a few exceptions, while his team planned new strategies to handle irregular immigration.

When the president took office, the acting secretary of DHS (Department of Homeland Security) issued a memo, asking ICE (Immigration and Customs Enforcement) to pause deportations no later than Friday, January 22.

ICE followed this order and started a 100-day moratorium on deportations for most immigrants with final removal orders, who are currently in the US and have been physically present since before November 1, 2020.

Texas Attorney General files legal complaint against the Biden administration

On Friday, January 22, Texas Attorney General, Ken Paxton, filed a lawsuit and a motion for a Temporary Restraining Order (TRO) against Biden’s 100-day moratorium on deportations.

Paxton states that the US President has a duty to comply with immigration enforcement law and protect the American population from any illegal activity, including irregular immigration. The Attorney General declares that restricting deportations is “unlawful and perilous” and would tremendously affect the state of Texas and its citizens.

Aside from the legal complaint, Paxton also sent a letter to the Acting Secretary of DHS, who ordered the moratorium on deportations, asking him to rescind this order as it violates an agreement made between Texas and the Trump administration earlier this month. In fact, the Attorney General states: “Border states like Texas pay a particularly high price when the federal government fails to faithfully execute our country’s immigration laws.”

The Biden administration has yet to respond to this legal complaint.
