According to local law, unaccompanied minors apprehended at the US borders must be transferred by border forces such as CBP (Customs and Border Protection) to HHS (Department of Health and Human Services) facilities within the first 72 hours.

Under the Biden administration, what HHS is doing is transferring unaccompanied minors to a sponsor or family member within the US, which was the regular process before the health crisis. However, due to the high number of minors arriving in the US and the fact that the Trump administration never invested in infrastructure for immigrant children, HHS is not keeping up with demand for facilities and is not expediting the relocation process as quickly as it should given the current border situation.

Thus, border forces are keeping large numbers of minors in facilities that do not have the necessary supplies for children, such as Border Patrol stations. As a result, the pressure on HHS and processing times at its facilities are growing, including pressure from border entities.
