Biden overturned Trump’s Muslim ban

Since former President Trump took office in January 2017, he used multiple tools and resources at his disposal such as Executive Orders, Memoranda and Presidential Proclamations to decrease immigration in the US and restrict the entry of certain nationals into the country.

For instance, Trump’s so-called Muslim Ban was one of the strongest impacts of his administration on the immigration sector. Through several presidential proclamations (PP 13769, PP 13780, PP 9645, PP 9983), the former president restricted the entry of immigrants from more than 10 countries, mostly Muslim territories, stating that this rule would prevent the presence of terrorists in the US.

When President Joe Biden took office on January 20, 2021, one of his first actions was to issue a presidential proclamation lifting Trump’s travel bans on several countries around the world. Therefore, Trump’s Muslim Ban is no longer active and migrants from those nations can now apply for a permit to enter the US, taking into account that some health emergency restrictions are still in effect.

The Biden administration will reconsider denied immigration applications

Two days after President Biden took office, the DOS’ (Department of State) Bureau of Consular Affairs issued a statement, declaring that since the current president rescinded Trump’s Presidential Proclamations that banned the entry of nationals of certain countries, DOS will review the possibility that applicants, whose immigration cases were rejected under Trump’s Muslim Ban, have a second chance and their applications are reconsidered.

This is truly hopeful news for thousands of immigrants affected by Trump’s restrictions, whose applications were approved, but have not been able to come to the US and many of them have already lost the opportunity to enter the country due to the time limit established in their specific application.

Diversity Visa Lottery winners await a new opportunity

Dozens of winners of the Diversity Visa Lottery were unable to enter the US due to restrictions implemented by former President Trump on Muslim territories. It is important to clarify that the Diversity Visa Lottery grants permanent legal residence, or Green Card, to winners.

Annually, millions of immigrants apply to this lottery but only a portion receive the Green Card. They have a set period of time to process their applications, submit the necessary documentation, and enter the US. However, hundreds of immigrants lost the opportunity to come to the country due to Trump’s Muslim Ban and many of them had already sold their personal belongings and quit their jobs after winning the Diversity Visa Lottery.

Therefore, they hope that the Biden administration will allow them to reapply to legal permanent residence or offer them some kind of benefit after lifting Trump’s restrictions on the immigration system.
