In December 2020, thanks to the intervention of a New York judge, former President Donald Trump’s administration had to reinstate DACA (Deferred Action for Childhood Arrivals) with its original parameters, those initially implemented by the Obama administration in 2012.

To give a little more context, DACA is a deportation relief program that currently protects hundreds of thousands of young immigrants known as Dreamers, who were brought to the US without legal documentation when they were minors and who, for the vast majority, have lived in North America for as long as they can remember.

Through DACA, eligible Dreamers are protected from deportation for two years with the possibility of extension and have access to other benefits such as employment authorization.

However, despite the fact that DACA recipients won the legal battle against the Trump administration, there is currently a backlog of DACA applications that could jeopardize the future of thousands of Dreamers in the US.

From December 2020 through March 2021, about 50,000 Dreamers submitted their initial DACA applications, but the USCIS (US Citizenship and Immigration Services) has only adjudicated 1.5%, approximately 800 DACA applications. This means that the number of pending DACA applications must be much higher today.

According to the USCIS, the reason why it has been unable to expedite DACA application processing is because of a backlog of immigration cases of all kinds, which lengthens waiting times for most processes and increases the workload for the agency’s employees.

Regarding the DACA program specifically, the Biden administration recently announced that it will assign more immigration officers to review these applications, streamline the process and reduce the backlog of cases, according to a CBS News report.

Adding to that, the USCIS plans to conduct public campaigns to remind eligible Dreamers of the steps they must take to file their DACA applications and how to reduce waiting times, which is also related to the responsibility of submitting a complete and strong immigration application.
