The Trump administration’s ideals and goals led to the implementation of hundreds of restrictive policies on all kinds of immigration processes. In fact, the previous administration’s intention was precisely to reduce immigration levels in the US, both legal and illegal. To give a specific example, President Trump issued a series of Presidential Proclamations that substantially restricted the entry of nationals of more than 10 countries (mostly Muslim) into the US. This includes migrants who had already received a positive response to their immigration applications, and, apart from that, thousands of new applications were also rejected under these proclamations. These rules and restrictions are known as Trump’s “Muslim Ban”.

The Biden government opened a door for immigrants affected by the “Muslim Ban”

Since President Biden took office on January 20, 2021, immigrant communities, including those affected by the “Muslim Ban,” have expected his administration to repair damages caused by the previous administration and allow them to resubmit rejected immigration applications under Trump’s restrictive policies.

During Inauguration Day (January 20), President Joe Biden issued a Presidential Proclamation permanently revoking restrictions implemented by Trump on more than 10 Muslim and African countries. Therefore, the so-called “Muslim Ban” is no longer active and nationals of those countries can start their immigration journey as long as they meet eligibility requirements, taking into account that some restrictions on grounds of health emergency are still in place.

Two days after President Biden took office, the DOS (Department of State) declared that it would evaluate the possibility for migrants, whose applications were rejected under Trump’s “Muslim Ban”, to resubmit their applications and start their immigration process.

DOS will reconsider denied immigration applications under Trump’s “Muslim Ban”

On Monday, March 8, 2021, Biden’s DOS stated that immigrants whose requests were rejected under Trump’s “Muslim Ban” can now resubmit their applications and pay the fee corresponding to their immigration process.

Migrants whose applications were rejected before January 20, 2020 must submit new applications, while migrants whose applications were rejected after January 20, 2020, can submit a reconsideration request and do not have to pay additional fees.

This is truly hopeful news for thousands of foreigners who have been unable to enter the US due to the Trump administration’s restrictive policies. Many of them applied for permits to reunite with their families. Hence, DOS’ decision to reconsider their applications definitely opens a door of joy for them.
