It is no secret that the Trump administration almost completely transformed multiple aspects of the immigration system as we know it. The current president of the US refers to immigration with a negative connotation, arguing that it threatens the safety and well-being of the American population.

His opinion is stricter when it comes to illegal immigration. According to the Trump administration, immigrants who decide to cross borders without legal documentation violate local law and, therefore, should not have the opportunity to obtain legal residence permit in the country.

That is why, during Trump’s term, operations of the Immigration and Customs Enforcement (ICE) agency increased considerably. ICE conducts exhaustive investigations to locate undocumented immigrants across the US and carries out operations to detain and deport them in the shortest possible time.

The Trump administration argues that more foreigners will try to violate immigration law and cross borders without prior authorization if they have alternatives to obtain work permits or legal residence and, therefore, deportation is the best solution to curb the massive flow of undocumented immigrants at the borders.

Current circumstances of undocumented immigrants in the US

Due to the authority and power that the Trump administration has given to border entities such as ICE, fear, anguish and anxiety are common among immigrant communities in the US, mainly those without legal documentation.

As a result, hundreds of undocumented immigrants have chosen to seek help, protection, and refuge in the so-called “sanctuary cities or jurisdictions,” which have laws that ban the cooperation of law enforcement agencies with border forces. Adding to that, many immigrant families are also protected by religious organizations and facilities, where ICE does not have access.

It is important to clarify that there are undocumented immigrants who have resided in the US for decades and know almost nothing about their countries. Therefore, they remain here hoping to find a viable way to request legal documentation and leave the fear of deportation behind.

Hence, their future depended almost entirely on the results of the presidential elections, which took place on November 3. President Trump was seeking re-election; however, Democratic candidate Joe Biden took the victory and will be the country’s 46th president.

Biden plans to create a path to citizenship for nearly 11 million undocumented immigrants currently residing in the US. He states that more than half of undocumented immigrants are people who overstayed their visas, but did not cross the borders without legal documentation.

Adding to that, the Biden administration wants to “grow the economy and expand economic opportunity across the country by improving and increasing opportunities for legal immigration.” In his view, undocumented immigrants help the country and “contribute to our communities every single day.”
