Qualified foreigners and their closest relatives

Throughout history, the US has strengthened its economy thanks to local workers who, for many generations, have contributed to creating the largest economy in the world with their innovative ideas. Adding to that, the country has also found stability, vitality and strength thanks to the presence of foreigners, who provide their services in different important sectors of the market.

In fact, in order to attract talent from abroad, the US has several options available to international workers. For instance, local companies often use the H-1B visa program to hire highly qualified foreign workers in fields such as science, technology, research and engineering.

Thanks to this program, H-1B visa holders have the possibility to bring their spouses through the H-4 visa. Adding to that, H-4 visa holders usually also have the ability to apply for employment authorization, so long as they meet certain eligibility requirements.

Lawsuit against work permits for H-4 visa holders

Naturally, there is a part of the population and certain members of the government who do not support immigration and state that foreign workers take opportunities away from American workers, supposedly increasing the local unemployment rate; a premise contradicted multiple times by experts and extensive research.

Therefore, different groups have started legal processes to decrease immigration levels or remove certain immigration programs, especially those related to employment or study.

To give a specific example, in 2015, a group of IT (information technology) workers filed a lawsuit to prevent H-4 visa holders from applying for a work permit in the US. This request would affect approximately 90,000 people and, at the same time, their employers.

However, under the Donald Trump administration (2017-2021), this legal process was never completed. Now, both plaintiffs and immigrant advocates are calling for resolution of the case.

Google leads group to uphold work permits for H-4 visa holders

On Friday, May 14, 2021, Google announced that it is leading a coalition of 30 companies to uphold and protect employment permits for H-4 visa holders, who are also essential workers in minority sectors and are part of the local social fabric.

Companies involved in the case state that if the Washington judge agrees to remove work permits of H-1B visa holder spouses, this would not only affect the local economic system, but would also affect immigrant families who depend on two salaries to have a good quality of life in the US and to be able to help their beloved ones abroad.
