Background

The Trump administration tried to eradicate DACA by any means possible between 2017 and 2021, stating that offering amnesty to undocumented immigrants was a bad strategy.

Thus, under Trump’s term, DACA was inactive for a considerable period of time and hundreds of thousands of Dreamers were in limbo.

Judge rules against DACA

In the midst of a legal process, a federal judge in Texas ruled against DACA in mid-July 2021, explaining that the Obama administration did not follow the regular process when it initially implemented it and, thus, it is invalid.

The federal judge suspended new enrollments in this immigration program, but his ruling does not affect Dreamers who are already DACA recipients, although that could change.

Biden attempts to protect DACA

Following the Texas judge’s ruling, the Biden administration issued a Notice of Proposed Rulemaking in late September, which seeks to recreate DACA from its inception, this time following the judge’s comments.
