Organizations ask Biden and Congress to support path to citizenship

On Wednesday, September 29, a group of 57 organizations focused on civil and human rights sent a letter to President Biden, Vice President Harris and certain members of Congress, asking to include a path to citizenship in the budget package.

Interestingly, that same day the Senate Parliamentarian rejected the second proposal by Democratic Leaders to include an immigration resolution in the 2022 spending bill.

Returning to the organizations’ subject, they state that “The budget reconciliation bill remains the most viable opportunity to finally make this reform to the US’ unfair immigration system”.

These organizations call on the Biden administration and Congress to move forward with the path to citizenship for essential undocumented workers in the budget package regardless of the Senate Parliamentarian’s ruling or the opinion of any other member of Congress.

Immigration reform through the reconciliation process

To understand the issue at hand, it is important to explain that the reconciliation process would allow Democratic leaders to pass the budget package with only 51 votes in the Senate, that is, without confronting the Republican filibuster.

Therefore, given that obtaining bipartisan support in Congress at this time is nearly impossible, the budget reconciliation process would allow the Biden administration to accomplish comprehensive immigration reform by opening a path to legalization for millions of immigrants currently residing in the US undocumented, who are a pillar for the national economy.

Senate Parliamentarian’s decision affected Biden’s plans

Initially, the Biden administration included an immigration resolution in the 2022 budget package, which proposed to open a path to legal permanent residency for essential foreign workers such as Dreamers (young immigrants who came to the country as children), undocumented farmworkers, TPS (Temporary Protected Status) beneficiaries, inter alia.

However, the Senate Parliamentarian rejected the immigration language in the spending bill on September 19. After this event, Democratic leaders tried to introduce another proposal, but the Senate Parliamentarian also rejected it.

Therefore, the Biden administration is currently trying to find other alternatives to promote the first comprehensive immigration reform in decades in order to offer permanent protection to undocumented immigrants who are essential workers in all kinds of sectors of the local market.
