Immigration reform is currently in limbo

Promoting immigration reform in Congress has always been a priority for the current President of the US, Joe Biden, who took office in late January 2021, just over five months ago. During his early days as leader of the White House, President Biden unveiled a rather ambitious immigration bill, which would substantially transform the way the government approaches the immigration sector in general.

Biden’s immigration bill includes and encompasses almost every branch of the local immigration system, from employment-based options and foreign farm workers, to undocumented immigrants, border protection methods, deportation protocols, inter alia.

The Biden administration is fully aware that getting bipartisan support in Congress to pass its immigration bill, especially in the Senate, is quite a difficult task, even more so at this time when the country is experiencing a surge of illegal border crossings.

Therefore, President Biden recently announced that his immigration bill does not necessarily need to be scrutinized or revised as a single piece of legislation or as a single extensive proposal, but that his administration is completely open to the idea of tearing the immigration bill to pieces so that Congress passes certain legislation it already agrees with.

Despite the Biden administration’s piecemeal approach to immigration reform, it appears as if it is currently in limbo because Congress has not yet made any decisions on the issue.

Democratic leaders propose using reconciliation for immigration reform

On Tuesday, June 29, 2021, a group of Democratic leaders met to discuss comprehensive immigration reform, especially when it comes to a path to legalization for more than 11 million immigrants currently residing in the US undocumented.

The New Sanctuary Movement of Philadelphia hosted the meeting and, during the session, Democratic leaders commented on the importance and urgency of promoting immigration reform in Congress to protect undocumented immigrants, especially those who are essential workers and contribute greatly to the national economic strength.

Democratic leaders discussed the possibility of using the budget reconciliation process to pass comprehensive immigration reform without the need to obtain 60 votes in the Senate, as established by the regular process. If the Biden administration decides to use the reconciliation process, it would only need 51 votes in the upper chamber, which is the exact number that the Democratic party currently has.

Senator Bob Casey, who participated in the meeting, openly stated, “I have supported a pathway to citizenship for 11 million undocumented individuals in our country and I will support it through the budget reconciliation process”.
