DACA’s Future Might Change with Biden

Joe Biden wins election and the future of DACA could change

Young immigrants protected by DACA

Thousands of immigrants come to the US annually, who yearn to build a promising future for their families or try to flee the danger, persecution and violence of their countries. This includes immigrant minors.

During Barack Obama’s term, in 2012, the Deferred Action for Childhood Arrivals (DACA) was implemented, which protects immigrants from deportation, who came to the US when they were minors and do not have legal documentation.

Normally, this immigration benefit offers them protection for two years, with the possibility of renewal. Adding to that, they have access to multiple options such as legal work permit, study and many others.

DACA during the presidency of Donald Trump

During the last couple of years, young immigrants protected by DACA have had quite difficult time under the Trump administration, who has tried to remove this program on multiple occasions, until the Supreme Court of Justice intervened and ruled in favor of DACA in June, 2020, denying the government’s request to remove it from programs offered to immigrants in the US.

However, despite the Supreme Court’s mandate, the Trump administration did not follow its verdict and is currently not receiving new DACA applications and is renewing existing permits for only one year instead of two.

This definitely sparked a gigantic controversy in the country, mainly because the Trump administration is disobeying an order from the Supreme Court, which could generate multiple legal inconveniences and affect the residence of more than 600,000 immigrants covered by this program.

The reason why the Trump administration wants to remove DACA is because, in its opinion, immigrants who cross borders without authorization or without an immigration process, including minors, are violating local law and should not have benefits or possibilities to legally reside in the US.

Joe Biden won the election and the future of DACA could change

It is well known that the American population elected Joe Biden (Democrat) as the next President of the US, who will take office in January 2021.

Biden proposes drastic changes to the local immigration system, which greatly benefit immigrant communities currently residing in the country, including DACA recipients.

In fact, since Biden launched his presidential campaign, he has mentioned on several occasions that he will continue to protect young immigrants who, in his opinion, are essential to the US workforce and contribute greatly to the socioeconomic development of local companies.

The nation’s next leader states that he will protect DACA recipients and remove uncertainty and doubts caused by the Trump administration with its constant intention to remove this immigration program.
