DACA Ruling Increases Pressure on Immigration Reform

After DACA ruling, pressure mounts to promote immigration reform

The USCIS can no longer approve new DACA applications

Following a verdict by a federal judge in Texas, the USCIS (US Citizenship and Immigration Services) can no longer approve new applications for DACA (Deferred Action for Childhood Arrivals), which is a deportation relief program that protects young immigrants who came to the US as minors, also known as Dreamers.

On Friday, July 16, the federal judge ruled against DACA, stating that the program itself is illegitimate and does not meet the mandatory requirements to be an immigration benefit. This is because then President Barack Obama’s administration did not follow regular protocols when implementing DACA in 2012.

Currently, this program protects more than 600,000 Dreamers from deportation and allows them to access multiple social benefits such as the ability to apply for employment authorization and work legally in the US, which has allowed these young immigrants to become essential workers in all kinds of sectors of the local market.

Nevertheless, after the Texas judge’s ruling, Dreamers eligible to submit an initial application can no longer become DACA recipients or be protected under this immigration benefit. As a result, their future in the US is now uncertain.

After DACA ruling, pressure mounts to promote immigration reform

Since the vast majority of Dreamers are people who have resided in the US for as long as they can remember and are basically an essential part of the country’s socio-cultural fabric, one of the main focuses of immigrant rights advocates and activist groups has always been to offer a path to legalization for these young immigrants.

Therefore, after the Texas judge’s ruling, the Biden administration is facing great pressure from immigrant communities to push for comprehensive immigration reform in Congress and offer some sort of guarantee to Dreamers. Currently, there are several immigration bills that could open a path to permanent legal residence and eventually citizenship for young immigrants who meet certain eligibility requirements.

However, the controversy surrounding immigration has grown quite heated recently, which has also affected Congress’ decision on certain immigration legislation. As a result, the Biden administration is using every tool and resource at its disposal to protect Dreamers, who are no longer just part of an immigrant community, but are also essential workers and a pillar of the national economy.
