DACA recipients are in limbo

The Barack Obama administration implemented several immigration programs such as Deferred Action for Childhood Arrivals (DACA). This immigration benefit was implemented in 2012 and protects undocumented foreigners from deportation, who came to the US when they were minors.

Normally, DACA offers protection for two years with the possibility of extension. With this permit, young immigrants can apply for employment authorization, legal documentation, study and many other benefits.

However, unlike former President Obama, the current President of the US, Donald Trump, does not agree with offering this benefit to people who violated the law by crossing borders unlawfully. Thus, for the past four years, the Trump administration has tried to eradicate DACA from programs offered to immigrant communities in the country.

After a seemingly endless legal battle, several trial courts and even the Supreme Court intervened in the DACA case. In fact, the latest ruling by a federal judge protected young people covered by this program or “Dreamers.”

Although the judge decided to protect DACA recipients, they do not feel safe because the current administration has tried to change, remove, transform and restructure this program on multiple occasions, so the judge’s decision could be challenged again.

DACA reinstatement is not enough

On December 4, the federal judge ordered the Trump administration to restore DACA and follow parameters established by the Obama administration as of Monday, December 7. The Trump administration complied with the order and the US Citizenship and Immigration Services (USCIS) is already receiving new DACA applications.

However, dozens of DACA recipients do not feel safe with the judge’s mandate because the Trump administration could challenge the ruling in a higher court, as it has done before. They ask for some kind of guarantee for their future since DACA is not a permanent program and could be removed by the government at any time if the judicial system allows it.

In fact, a “Dreamer” who gave her opinion on the judge’s ruling stated that the DACA program will always depend on the country’s administration and the political party to which it belongs, which makes it quite unstable to be a benefit that protects more than 700,000 people. “We can’t move forward in the real world and live freely. It feels like an invisible chain holding me back (…) I’m still worried about my status (…) They’re playing with us to a certain degree and it’s not right or adequate. You’re playing with a society that’s giving back to the community.”
