Advocates Legally Challenge Biden over Title 42 Again

Advocates will no longer help Biden because of Title 42

The global pandemic and border restrictions

It is clear that the Trump administration had the intention and purpose to reduce immigration levels in the US, arguing that the massive influx of foreigners is a negative thing for the country. Trump’s anti-immigrant narrative was undoubtedly one of the most striking and influential aspects for the American population during the 2016 election, especially considering that we are in the 21st century and that, thanks to technology, international transit is quite high nowadays.

Therefore, between 2017 and early 2021, we could witness how far the executive power of an administration whose goal is to restrict immigration goes, without congressional intervention. Adding to that, the health crisis caused by the global Coronavirus pandemic allowed the Trump administration to narrow immigration alternatives even further, especially when it comes to humanitarian programs such as political asylum and employment-based immigration.

In fact, on health emergency grounds, former President Trump employed Title 42, which allowed his administration to implement border restrictions related to the health risk and the spread of highly contagious diseases such as COVID-19. Under Title 42, border forces can ban immigrants from entering the US and conduct express deportations.

Biden between a rock and a hard place

Biden arrived at the White House with the ideal of reforming the entire immigration system, which undoubtedly includes lifting restrictions implemented by Trump, including those related to the global Coronavirus pandemic such as Title 42.

Thus, since President Biden took office in January 2021, several activist groups and immigrant rights advocates have urged his administration to lift Title 42 and have even supported Biden’s immigration plans and assisted vulnerable communities such as asylum seekers in the border territory.

However, due to an alarming surge of illegal border crossings, the Biden administration has kept the borders closed to most non-essential travel through Title 42.

Advocates will no longer help Biden because of Title 42

Several humanitarian organizations and advocacy groups, including ACLU (American Civil Liberties Union), which were cooperating with the Biden administration to lift Trump’s border restrictions, will no longer wait and plan to challenge Biden over Title 42.

In fact, a member from ACLU openly stated, “The Biden administration has left us no choice but to go back to court. It’s been seven months, and Title 42 is still in place”. These groups are calling on Biden to lift the current border restrictions, which substantially narrow the alternatives available to the most vulnerable immigrant communities.
