The “Remain in Mexico” policy

Referring specifically to the political asylum process, the Trump administration states that asylum seekers take advantage of the opportunity to work in the US while awaiting responses to their immigration cases. According to the president’s opinion, it usually takes months or even more than a year to receive an answer to asylum requests and most applications are rejected because immigrants do not meet the mandatory requirements.

Therefore, the Trump administration signed an agreement with the Mexican government called the Migrant Protection Protocol (MPP), also known as “Remain in Mexico”, which states that asylum seekers must remain in Mexico while they receive a response to their asylum applications.

With this policy, the Trump administration prevents asylum seekers from residing in the US before their applications are approved.

Pandemic also delays political asylum hearings

Adding to Trump’s immigration policies, which have been classified as “arbitrary and capricious,” the arrival of the global Coronavirus pandemic substantially delayed political asylum hearings since immigration courts and the US Citizenship and Immigration Service (USCIS) offices closed for a considerable period of time.

Therefore, apart from imminent risk that asylum seekers currently face in Mexico’s cities, waiting times are even longer now due to the health crisis.

Attorneys and activists demand hearings for asylum seekers

Dozens of activists and attorneys raised their voices, calling for the President-elect Joe Biden and his cabinet to assist asylum seekers in South Texas.

They ask for hearings, postponed by the health crisis, to resume as soon as possible to protect the integrity of asylum seekers and allow them to request international protection. However, the Department of Homeland Security (DHS) and the Department of Justice (DOJ) state that Centers for Disease Control and Prevention (CDC) must give the green light for hearings to resume in all immigration courts across the US.
