The controversy surrounding DACA seems endless

The Deferred Action for Childhood Arrivals (DACA) is a benefit that protects immigrants from deportation. They came to the US without legal documentation as minors, who are also known as “Dreamers.”

This program was implemented in 2012, during Barack Obama’s term. Currently, there are more than 600,000 immigrants covered by DACA. With this program, they have the possibility to obtain employment permits and many other benefits.

Initially, DACA offered protection from deportation for two years and beneficiaries had the possibility to renew it. However, the current administration of the US, headed by President Donald Trump, has tried to remove DACA on multiple occasions and recently changed the guidelines for beneficiaries of this immigration program.

In the opinion of the Trump administration, undocumented immigrants, who crossed the borders unlawfully, should not have the possibility to obtain legal residence permits or protection against deportation since, according to the president, that would only increase illegal immigration. This includes immigrant minors.

The Supreme Court of Justice intervened in the DACA case

The controversy and legal battle over DACA reached the the US’ Supreme Court of Justice, which, in June 2020, ruled in favor of Dreamers and rejected the Trump administration’s request to remove this benefit.

It is important to understand that the Supreme Court heads the country’s federal judicial system and has the right and power to make the final decision on disputes that were not resolved by lower courts, following its motto “Equal Justice Under Law.”

However, despite the Supreme Court verdict, the Trump administration did not comply with the order and:

  • It is not receiving new applications for DACA.
  • It is renewing DACA only for one year instead of two.

Naturally, since the Trump administration is, in the opinion of DACA recipients and activists, disobeying the Supreme Court and breaking the law, the controversy has increased substantially in recent months.

DACA recipients sue the Trump administration

The current administration of the US has faced multiple legal processes due to its intention to remove DACA from programs offered to immigrants. However, it was expected that after the intervention of the Supreme Court, this controversy would cease.

Since it did not happen and the Trump government failed to comply with the supreme mandate, on Tuesday, November 3, 2020, DACA recipients and immigrant rights advocates filed another lawsuit against the current administration for not following the order.

It is important to remember that the US presidential elections took place the same day and, in fact,  Dreamers stated: “We had to take this legal step at this time of elections because the Government of Donald Trump has refused to comply with the order of the Supreme Court.”
