Virginia Attorney General Disagrees with Restriction on Work Visas

23 attorneys general present a Amicus Brief against work visa restrictions

The Trump administration’s restrictions

It is clear that the current administration of the US, headed by President Donald Trump, has always had the intention of reducing immigration and its views regarding foreigners who cross the borders without legal documentation is strict, compared to predecessor governments, and has been classified as “arbitrary” on several occasions.

Nowadays, with the massive outbreak of Coronavirus in the North American territory, the Trump administration implemented emergency measures that clearly affect immigration processes.

For instance, speaking specifically about skilled foreign workers, the government suspended the issuance of work visas until 2021. This government decision has several purposes:

  1. Protect the employment of American workers.
  2. Reduce the unemployment rate.
  3. Avoid a possible saturation of the country’s economic system.

Therefore, local companies should hire only American personnel during the health crisis.

This emergency measure sparked a gigantic controversy among immigrant rights advocates, critics, activists, world-renowned companies and several sectors of the local market.

Other than that, multiple attorneys general from different states have voiced their disagreement with this sudden change in business immigration policies. Among those states is Virginia.

Virginia attorney general raises his voice

Virginia attorney general (Mark Herring) announced on Monday, August 10, 2020, his intention to join 23 other attorneys general in presenting an official statement (Amicus Brief) expressing dissatisfaction, disagreement and concern regarding the restrictions implemented by President Trump on work visas.

In the official statement, the attorney general assures that “Immigrants and foreign-born employees play an integral role in Virginia’s communities and add billions to our economy every year (…) I’m proud to join with my colleagues to defend legal immigrants and this country’s incredibly important work visa programs.”

Besides that, the 23 participants argue that banning the entry of highly qualified foreign workers profoundly affects sectors such as technology, science, economy, development, research, innovation, inter alia.

In addition to that, the attorneys general involved in the complaint agree that this government decision only shows the “capricious” intention of the Trump administration to reduce legal immigration and they assure that repercussions could worsen the economic and social crisis caused by the arrival of the global pandemic.

Thus, attorneys general hope they can step in and help overturn current restrictions on work visas, which are greatly beneficial to America’s business competitiveness.
