The USCIS temporarily waives medical examination rule for immigrants

On Thursday, December 9, the USCIS (US Citizenship and Immigration Services) announced that it will temporarily waive the ’60-Day Rule’ for immigration applications requiring a Report of Medical Examination and Immunization Record.

Before going into detail, it is important to explain that the USCIS is the entity in charge of processing immigration applications in the country.

What is the ’60-Day-Rule’?

Most immigration proceedings, including applications for lawful permanent residency, require a Report of Medical Examination and Immunization Record signed by a civil surgeon via Form I-693, which serves as proof that immigrants do not suffer from any disease or physical condition that would make them inadmissible to the US.

In 2018, the Trump administration implemented a Medical Examination and Immunization Record validity rule called the ’60-Day Rule’, which states that the civil surgeon’s signature should not exceed 60 days when filing Form I-693.

The USCIS hopes to reduce immigration backlogs

Due to the global Coronavirus pandemic, Trump’s ’60-Day-Rule’ has tremendously affected most immigration processes due to the backlog of pending cases across the country and delays resulting from the closure of USCIS offices.

Therefore, through the policy update, the “USCIS is temporarily waiving the requirement that the civil surgeon’s signature be dated no more than 60 days before the applicant files the application for the underlying immigration benefit”.

This temporary waiver went into effect immediately and will be in active until September 22, 2022.
