USCIS Expands Premium Processing

New USCIS Rule

New USCIS Rule

On Wednesday, March 30, DHS (Department of Homeland Security) published in the Federal Register a Final Rule to address the immigration backlog.

These new guidelines are directly related to the processes of USCIS (US Citizenship and Immigration Services), the entity in charge of reviewing and responding to immigration applications in the country.

The Parameters of the Rule

According to the Final Rule:

  • Eligible American employers will be able to pay a higher fee, called a premium fee, to expedite their immigration applications.
  • Eligible foreigners will also be able to pay the premium fee to expedite their processing.

It is important to explain that premium processing will only be available for certain specific immigration categories, especially those related to business immigration programs.

In addition, the USCIS also changed several parameters regarding the renewal of employment permits to simplify the process for foreign workers and reduce unnecessary expenses.

The Background of the Rule

Due to the vast backlog of immigration cases across the US, waiting times tend to be quite long for most immigration proceedings.

Therefore, the USCIS seeks with the new rule to reduce waiting times and streamline existing processes to benefit both foreign populations and the local immigration system.

It is worth mentioning that the rule will not go into effect until 60 days after its publication since, as due process, it must go through public comment.

Aside from that, the rule not only benefits foreign nationals who wish to work or invest in the US, but also hundreds of thousands of American employers who are having trouble hiring due to labor shortages that threaten national economic stability.
