The Temporary Protected Status (TPS) is a permit available to immigrants residing in the US that protects them from deportation proceedings.

Currently, this program is available to foreigners from 10 countries who cannot return to their homes due to armed conflicts, natural disasters or epidemics.

The TPS holders can apply for legal work permits and many other benefits, depending on the state in which they reside and local laws.

In addition to that, immigrants covered by TPS can choose a path to obtain Legal Permanent Residence (LPR), also known as Green Card.

Previously, immigrants with TPS could travel outside the US and then return without posing a threat to their legal residence in the country.

However, due to the Trump administration’s stance on immigration, several rules have been implemented in the TPS program and the path to legal residency is increasingly difficult.

That is the reason why a group of immigrants presents a legal complaint against current restrictions on the TPS program and the options they have to obtain a Green Card.

Lawsuit against restrictions on TPS and LPR

A group of seven immigrants filed a lawsuit against the current administration of the US, arguing that President Trump is threatening their legal residency, jeopardizing their future and leaving them without tools to face possible deportation proceedings.

The participants in the lawsuit are TPS holders and some of them have traveled outside the US with prior authorization. They could return to the country and go through the legal process to obtain a Green Card or even to become American citizens.

However, in December 2019, the Trump administration proposed removing this benefit and restricting TPS holders from applying for a Green Card if they have traveled outside the country and previously had a deportation order.

This means that the plaintiffs would not have the possibility to request LPR and that is the reason why they ask the Court to intervene and allow them to continue with their immigration processes, mainly because some of them have resided in the US for more than 20 years.
