Supreme Court upholds reimplementation of MPP

The US Supreme Court recently upheld a Texas federal judge’s decision to reimplement the so-called “Remain in Mexico” program, formally known as MPP (Migrant Protection Protocols).

The Texas judge, who was appointed by Trump, ordered the Biden administration to revive the MPP policy, which states that asylum seekers must remain in Mexican territory until they receive a response to their immigration cases, which usually takes a considerable period of time.

Naturally, because asylum seekers are individuals seeking international protection while trying to flee risky situations, they arrive at the US’ borders without personal belongings. Therefore, under the MPP policy, they live in meager conditions in Mexico, where they survive on donations from surrounding communities and humanitarian organizations.

It is worth clarifying that this program was implemented by the Trump administration at the beginning of 2019 and was intended to prevent immigrants from entering the US before legitimately receiving political asylum status. The Biden administration had recently rescinded this policy, but the Texas judge’s order reverses this action.

It is important to clarify that, under Title 42, most undocumented immigrants apprehended in the border territory have been returned almost immediately on grounds of health emergency.

Nevertheless, the Biden administration has the ideal of reforming the entire immigration system, which includes the political asylum process, but the federal judge’s decision on MPP policy is now an obstacle for its plans.
