The New I-9 Form

I-9 form updated for skilled workers

The new form for foreign employees

The form I-9 to request qualified foreign workers has changed and will be implemented as of May 1, 2020.

The US welcomes thousands of foreign employees annually who constantly help boost the economy and create balance in the country.

Qualified employees must meet several requirements in order to come to the US:

  1. Have a valid diploma that demonstrates the corresponding studies in the work area.
  2. There must be no Americans available for the required job and therefore foreigners are required.
  3. They must focus on a specialized area of a company.
  4. They must know in depth the requirements of the position they applied for.

Typically, the local employer must submit the petition to the US Citizenship and Immigration Service (USCIS) in order to bring qualified workers.

Due to the Coronavirus situation, USCIS is receiving all applications online.

Both employer and employee must complete Form I-9 and submit it virtually for review and approval.

There are multiple reasons why the employer must complete the form as well:

  1. Verify the veracity of the local company.
  2. Verify the identity of the foreign worker.
  3. Guarantee the benefit that the foreign employee grants to the local company.
  4. Demonstrate that the employee has the necessary skills to help with the company’s progress.

Form I-9

USCIS made some changes to the I-9 form and gave employers more time to review and complete it correctly.

That is why the new form must be used from May 1, 2020.

Due to the pandemic, USCIS offices are not offering face-to-face services right now and employers fear that their request will be denied for filling out the new I-9 form incorrectly.

However, there are entities specialized in business immigration processes that can help you complete the form and avoid rejection.
