On Wednesday, December 8, the Biden administration sent the first two asylum seekers to Mexican territory amid the reimplementation of the MPP (Migrant Protection Protocols) program, also called “Remain in Mexico”.

The MPP policy was initially implemented by the Trump administration in 2019 and states that asylum seekers should remain in Mexican territory until they receive a response to their immigration cases, which usually takes several months.

The Trump administration explained that asylum seekers allegedly take advantage of the local immigration system to work in the US knowing that their applications will be rejected for not meeting eligibility requirements.

Why did the Biden administration have to reimplement the MPP policy?

The Biden administration has never agreed with the MPP program. In fact, in June 2021, it permanently rescinded this policy and created a resettlement program to assist asylum seekers who were still waiting in Mexico in the midst of the global pandemic.

However, in August, a federal judge intervened in the case and declared that the Biden administration did not follow due process in terminating the policy and should reinstate it as soon as possible.

When the Biden administration attempted to appeal this ruling, the US Supreme Court upheld the judge’s verdict. As a result, the Biden administration was forced to reinstate the MPP policy, which has generated criticism from immigrant rights advocates, who claim that Biden blindly accepted the judge’s order.
