The Biden administration to reinstate the MPP next month

The Biden administration recently announced that it is now ready to follow the Texas judge’s order and reinstate the “Remain in Mexico” policy in November 2021.

This rule, officially known as MPP (Migrant Protection Protocols), states that asylum seekers arriving at the US’ borders must wait in Mexican territory until they receive a response to their immigration cases.

Biden tried to remove this immigration policy

The MPP policy was initially implemented in 2019 by the Trump administration, but one of Biden’s first actions as president was to suspend this program in January 2021, stating that it goes against the values of the US as a nation of immigrants.

Adding to that, in June, Biden’s DHS (Department of Homeland Security) permanently rescinded the MPP policy through an official memorandum.

Judge weighed in on Biden’s plans on the MPP

In mid-August, a Trump-appointed federal judge for the Northern District of Texas ordered the Biden administration to reimplement the MPP policy, stating that it did not follow regular protocols to lift such a rule.

Aside from that, when the Biden administration tried to challenge the Texas judge’s decision, the Supreme Court upheld this ruling, stating that DHS did not measure the repercussions of removing this rule.

Biden still hopes to rescind the MPP policy

The Biden administration stated, after the Supreme Court ruling, that it would follow the Texas judge’s verdict and reinstate the MPP policy even though it runs counter to its immigration plans.

However, the DHS Secretary openly stated in late September that he plans to remove this policy again by issuing an update to the previous memorandum, which could address the judge’s and the Supreme Court’s concerns.
