Supreme Court Opens a Door of Hope for Deportation Cases

Convicted immigrants can now appeal deportation cases

Deportation cases reached the Supreme Court

After a long fight between the Trump government and the leaders of immigrant rights advocates, the concerns about deportations are being handled by the Supreme Court of Justice.

The current administration of the US has tried by all means to reduce immigration in the country and the established processes for deportations are not being followed correctly.

During the massive outbreak of Coronavirus in the US, deportations have been a very controversial topic since any immigrant who currently arrives at the borders is being deported almost immediately.

Due to the fact that immigrant rights advocates have repeatedly argued with the government about express deportations during the health crisis, the US Supreme Court of Justice decided to intervene.

A door of hope for immigrants

On Monday, June 1, 2020, the Supreme Court announced certain changes in deportation policies with a vote of 7 against 2.

The Trump government presented several arguments to the Supreme Court stating that:

  • Immigrants with active deportation cases should not be allowed to appeal the decision if the International Convention Against Torture (CAT) says they are not eligible.
  • If an immigrant is sentenced for crime or vandalism, he/she should not be allowed to reside in the United States and the only viable path should be deportation.
  • When immigrants cross borders illegally, they must be deported without having the opportunity to apply for legal residence.

Despite the arguments of the current government of the US, the Supreme Court of Justice gave immigrants an opportunity to challenge their deportation cases.

From now on, immigrants facing a deportation case have the right to appeal the decision in front of a judge if they are at imminent risk by returning to their countries.

The new deportation policy states that:

  • If immigrants have been convicted of a crime but are in danger of being tortured in their native country, they can appeal the deportation case, even if they are not protected by CAT.
