Supreme Court Intervenes in Public Charge Rule Again

Supreme Court rules on Trump's Public Charge Rule

Supreme Court rules on Trump’s Public Charge Rule

On Monday, January 9, the US Supreme Court rejected the request of several Republican leaders to reenact Trump’s public charge rule.

To understand the issue at hand, it is important to explain that the public charge rule refers to a series of eligibility criteria that determine whether an immigrant is eligible to become a lawful permanent resident through the adjustment of status process.

Since more than 100 years ago, when this rule was first implemented, each government has transformed and changed the public charge parameters according to its ideals and goals with respect to the immigration sector, specifying what makes an individual inadmissible to the US on the grounds of “Public Charge,” that is, excessive use of social services or public benefits.

The Republican leaders’ petition

A petition written by 14 Attorneys General from different States, addressed to the Supreme Court, explained why Trump’s public charge rule should be revived after the Biden administration terminated and completely rescinded it a couple of months ago.

However, the Supreme Court ruled against the Attorneys General’s appeal, stating that there was no need to re-implement a version of the public charge rule that has already been eliminated.

It is worth noting that the Trump administration significantly broadened the parameters of the public charge rule between 2017 and 2021, increasing the basic requirements to become a lawful permanent resident.
