Trump tried to curb immigration through the Public Charge Rule

Since thousands of migrants choose the US as their destination, attracted by employment opportunities and economic stability, the local immigration system also has certain guidelines and norms that must be followed in order to avoid a massive influx of immigrants to the North American territory.

There is an immigration policy that has been active for more than 100 years, according to the USCIS (US Citizenship and Immigration Services), and has been modified or temporarily invalidated on multiple occasions by several administrations. By this, we refer to the so-called Public Charge Rule.

Broadly speaking, the Public Charge Rule is intended to prevent immigrant communities from becoming a “burden” on the local economic system, taxpayers, and the federal government.

During the Donald Trump administration (2017-2021), this rule was involved in multiple legal processes since the former president considerably increased the Public Charge Rule’s parameters and used it to restrict immigration in the US.

Essentially, Trump’s Public Charge Rule states that certain immigration applications may be rejected or denied if applicants use public benefits such as Medicaid, housing vouchers, or food stamps for more than 12 months in a 36-month period.

Supreme Court invalidates pending cases related to the Public Charge Rule

The Trump administration had to face several legal processes due to the Public Charge Rule and it was invalidated and validated again on multiple occasions, until the US Supreme Court of Justice intervened to review the dispute over this rule.

However, the current administration, led by President Joe Biden, does not intend to uphold Trump’s Public Charge Rule in court.

Therefore, on Tuesday, March 9, 2021, the Biden administration, through the DOJ (Department of Justice) and several plaintiffs, filed a request to invalidate pending appeals related to Trump’s Public Charge Rule.

In response to this petition, the Supreme Court dismissed the Public Charge Rule-related appeals, which means that the legal battle regarding this restriction, which seemed endless, is over for now and immigrants can access public benefits as long as they meet eligibility requirements.

Dozens of immigrant rights advocates and activists involved in legal processes to rescind Trump’s Public Charge Rule raised their voices and praised the Biden administration for setting aside this policy, which forced immigrant communities to avoid seeking medical assistance and other social benefits amid the health crisis caused by the global Coronavirus pandemic.
