Senate Parliamentarian to comment on immigration provisions soon

The Senate Parliamentarian is currently reviewing Biden’s spending bill and could give her verdict as early as this week. This also includes her opinion on the immigration provisions included in the budget package.

It is important to clarify that the Senate Parliamentarian’s role is to be the advisor to this chamber of Congress and, therefore, to give his or her opinion regarding certain procedures and rules, including budget reconciliation processes.

To give a little more context, the Senate Parliamentarian has twice rejected the immigration language introduced in Biden’s spending bill:

  • The first proposal sought to open a path to citizenship for immigrants residing in the US undocumented, approximately 11 million.
  • The second proposal sought to update the Registry Provision in order to allow millions of immigrants to apply for Green Cards and become LPRs (Lawful Permanent Residents).

In both instances, the Senate Parliamentarian stated that modifying local immigration policies in such a way was not entirely a budgetary issue, but more of an update to the immigration system.

What if the Senate Parliamentarian accepts the immigration language this time?

The Democratic leaders’ third immigration proposal, which is under review by the Senate Parliamentarian, seeks to offer temporary amnesty (up to 10 years) to approximately 7 million undocumented immigrants through the parole power.

If the Senate Parliamentarian approves this immigration language, then Biden’s budget package would enter debate in the Senate and that would be the last step to officially become law.
