The Trump administration has the possibility to remove TPS

The current administration of the US has always tried to remove some humanitarian programs offered to immigrant communities currently residing in the country. This is mainly because the Trump government does not agree with offering legal residency possibilities to immigrants who decided to cross the borders without legal documentation, arguing that they violated local law and, therefore, should not receive benefits.

Adding to that, the Trump administration declares that offering these types of benefits would only incentivize and increase illegal immigration and that the local immigration system must try to eradicate it at all costs.

On the other hand, President Trump is also not entirely on board with mass legal immigration, which is why some legal programs are also on the tightrope.

That is the case of the Temporary Protected Status (TPS). This is a humanitarian program that protects immigrants from countries currently experiencing natural disasters, armed conflicts, epidemics, inter alia.

It is important to clarify that this permit is issued by the US Citizenship and Immigration Services (USCIS), one of the main branches of the Department of Homeland Security (DHS).

Normally, the DHS chooses TPS beneficiary countries and the requirements to apply, in addition to specifying the duration of the permit.

Currently, there are 10 countries included in the TPS program and most will be included until January, 2021, although some beneficiary countries have until March, 2021.

In addition to that, the Ninth Circuit Court of Appeals recently announced that the Trump administration has the power and right to remove TPS.

Protests against the court’s decision

On Tuesday, September 22, 2020, dozens of immigrants, mainly from El Salvador and Honduras (two of the countries covered by TPS), protested in San Francisco, California, expressing their dissatisfaction with the decision of the 9th circuit regarding the TPS program.

They declare that more than 300,000 people are currently covered by this program and will surely have to face imminent danger in their countries, risking their integrity. In addition to that, protesters argue that there are TPS beneficiaries who have resided in the US for decades and, for many of them, their countries are already an unknown place that does not offer opportunities of any kind.

Activist groups also declare that TPS recipients have built a life in this country, paid mandatory annual taxes, and contributed to the socio-economic development of the country through their work and effort.

They argue that “the (court’s) decision fails to acknowledge what we all know to be true, which is that the Trump administration has been motivated by its racism and its endorsement of white supremacy in its treatment of TPS holders.”

They ask for a second review by the Supreme Court of Justice before the validity of the TPS expires.
