New Rule Implemented for Asylum Applications

DHS wants to check the health of immigrants before granting asylum

The arrival of the global Coronavirus pandemic in the US has naturally affected certain communities more than others. There are sectors of society that have felt stronger impacts and have had to implement changes in order to survive and overcome the current health crisis.

For instance, immigrants planning to apply for asylum in the US are going through a difficult, confusing, and highly uncertain time of not knowing what the future holds.

The emergency measures implemented by the Trump government have left asylum seekers aside, helpless and aimlessly.

In addition to that, the Department of Homeland Security (DHS), together with the Executive Office for Immigration Review (EOIR), officially published on Thursday July 9, 2020, a series of measures that will reduce the number of asylum applications approved by the USCIS.

The new rule proposed by the DHS

Due to the threat to public health caused by the COVID-19 pandemic, the DHS proposes to consider the health condition of immigrants from now on before granting political asylum or allowing them to enter the US under any other legal permit.

Therefore, any immigrant with the following conditions will not be able to obtain political asylum or be protected from deportation:

  • A possible pandemic virus.
  • Communicable diseases by human contact.
  • Any underlying disease that may put the health of the American population at risk.

This new rule is intended to protect the public health of legal residents and citizens of the US, but at the same time makes it more difficult for immigrants to obtain asylum and increases the requirements for the applications. In addition to that, the rule protects express deportations and prevents a review process by a local judge.
