NYCLU files a lawsuit against "Remain in Mexico" policy

MPP – Brief explanation

It is well known that President Trump has a strict opinion when it comes to immigration and one of the main purposes of his political campaign is to reduce the number of foreigners entering the country, arguing that local resources must be protected.

One of the policies implemented during the term of President Trump is the Migrant Protection Protocol (MPP) or “Remain in Mexico”.

Basically, this is an agreement between the US and Mexico that states that asylum seekers must remain in Mexico until their immigration cases are resolved. In this way, the Trump administration prevents immigrants from residing in the US without legal documentation.

The current problem resides in the fact that the massive outbreak of Coronavirus in the North American territory threatens the lives of thousands of asylum seekers who are patiently waiting in Mexico for an opportunity to support their immigration cases before a local judge.

Why are their lives at risk?

According to the US Citizenship and Immigration Services (USCIS), political asylum is a program offered to immigrants who suffer persecution in their countries, whether because of their race, religious belief, political identity, sexual orientation, inter alia.

Therefore, it is important to clarify that they are trying to flee from danger and seek international protection to save their lives and in many cases the lives of their families. Normally, they start their journey to the US without belongings or money.

That is why they currently live in temporary shelters built on the borders of Mexico. These shelters are usually overcrowded and that increases the risk of a massive Coronavirus outbreak. On top of that, they have no food supplies and no medical personnel are available to help them.

The MPP controversy and the lawsuits

This policy has faced multiple legal processes and protests in recent years. For instance, in one of our most recent articles, we talk about a lawsuit filed by a group of women (some of them pregnant) who were returned to Mexico without money or protection.

Now, the New York Civil Liberties Union (NYCLU), which is an organization focused on the protection of civil rights and liberties in the US, has filed a new lawsuit against the MPP policy on August 25, 2020.

In the legal complaint, the NYCLU states that “The MPP is a transparent effort to deny immigrants the protection of the law, which guarantees that everyone can apply for asylum, and expressly forbids sending people to countries where they will be persecuted.”

The NYCLU openly argues that the Trump administration is evading the law, relying on “racist stereotypes” and without solid grounds.
