Deportations of immigrant minors

Since minors, especially those who arrive at the borders unaccompanied, are more likely to be victims of violence, kidnapping, abuse, human trafficking and other precarious situations, the US’ law is quite strict with this matter.

When border forces such as Immigration and Customs Enforcement (ICE), belonging to the Department of Homeland Security (DHS), detain unaccompanied immigrant minors, they must transfer them to the Office of Refugee Resettlement (ORR), a branch of the Department of Health & Human Services (HHS), where they must wait under the supervision of child care providers until a judge resolves their immigration cases.

However, due to the health crisis, border forces are not following these guidelines and immigrant minors are not always having the possibility to present their cases in front of a judge, but are deported almost immediately after arriving in the US.

In fact, the Trump administration is currently facing multiple legal proceedings simultaneously for evading responsibility to protect unaccompanied minors and for keeping them in hotels before deporting them in the midst of an unprecedented sanitary emergency, rather than transferring them to the ORR, as stated by local law.
