ICE faces two different lawsuits due to hygiene conditions in Detention Centers

ICE’s health protocols are in question

The massive outbreak of Coronavirus inside detention centers of the Immigration and Customs Enforcement (ICE), has caught the attention of hundreds of immigrant rights advocates, local judges, specialized attorneys, recognized entities, and non-profit organizations.

To give a specific example, The New York Times recently published the results of an investigation conducted in detention centers around the US and showed that ICE became a “spreader” of the Coronavirus both nationally and internationally.

In fact, when the first Coronavirus cases reached the US, dozens of immigrant rights advocates warned about the imminent threat present in these detention centers and mentioned that they could become hotbeds of the COVID-19, which indeed happened.

Recently, due to this great controversy generated by the arrival of the Coronavirus at ICE facilities, the US justice system intervened and decreed new hygiene measures and protocols that ICE must fully follow.

In addition to that, multiple immigration attorneys filed a lawsuit on Sunday, July 12, 2020 due to the conditions in which their clients live within ICE family detention centers.

A judge intervened for the welfare of immigrant families

On June 26, a California judge ruled in favor of immigrant families and ordered ICE to release minors before July 17 from three detention centers based in Pennsylvania and Texas.

This decision was made due to the imminent danger faced by minors detained in the midst of a global pandemic as contagious as the Coronavirus.

Now, the current controversy is that ICE is planning to release only minors, which would propagate family separation and possibly affect children’s development.

On Monday, July 13, ICE had a hearing in a local court where a judge had to decide whether ICE should release the parents along with the minors.

The new complaint filed against ICE

The day before ICE attended the hearing, several immigration attorneys filed a lawsuit against the hygiene and health protocols implemented by ICE within immigration family detention centers.

Attorneys argue that many of the minors’ parents have underlying illnesses that make them more prone to catch the nouvelle Coronavirus, and because there are not enough medical personnel, it could be catastrophic.

Therefore, the attorneys ask the Department of Homeland Security (DHS) to order ICE to release the immigrant families detained during the current juncture, both minors and parents.

The official response of the Court regarding the release of parents along with minors has not yet been shared with the public.
