Humanitarian Organization Comments on Political Asylum Restrictions

HRF comments on Trump's new Final Rule

The Trump administration’s opinion regarding political asylum

The US is the destination for thousands of immigrants, who are trying to protect their lives from danger, persecution, violence, abuse, war and other precarious situations. The most vulnerable immigrant communities often reach or cross the country’s borders to request international protection through humanitarian programs such as political asylum, DACA (Deferred Action for Childhood Arrivals), TPS (Temporary Protected Status), inter alia.

However, the current administration of the US, led by President Donald Trump, does not support humanitarian alternatives offered by the current immigration system. In fact, the president and his cabinet have referred to the political asylum process as “fraud, scam, and deception,” stating that “excuses” used by immigrants to seek asylum are fairly general and do not pose an imminent threat.

Adding to that, the Trump administration assures that most asylum applications are rejected, but that immigrants take advantage of waiting times to reside in the US and obtain economic benefits.

Thus, over the past four years, the Trump administration has focused heavily on tightening benefits for asylum seekers and increasing eligibility requirements.

New Final Rule limits possibilities to request political asylum

The Trump administration recently released a Final Rule that restricts and substantially reduces possibilities for immigrants to apply for political asylum.

The Final Rule, which will go into effect on January 11, 2021, increases eligibility requirements and leads to the rejection of hundreds of asylum applications without the possibility of a hearing with a local judge.

Since the Trump administration is implementing this rule just before leaving office (President-elect Joe Biden will take office on January 20, 2021), and thousands of asylum seekers will have no choice and will have to return to dangerous environments, several humanitarian organizations, activist groups and immigrant rights advocates raised their voices against this Final Rule.

HRF comments on Trump’s new Final Rule

The non-partisan humanitarian organization Human Rights First (HRF) recently commented on the Trump administration’s new Final Rule, which significantly restricts the political asylum process in the US.

HRF comments that this Final Rule could endanger the lives of thousands of innocent people simply because the Trump administration wants to reduce the number of asylum seekers in the US. Adding to that, the humanitarian organization states that “This rule is a clear violation of the Immigration and Nationality Act (INA), the intent of Congress, and the treaty obligations of the United States.”
